Terms of Use

These Terms of Use apply to your use of maku, an iOS and Android app by ptgms for taking, captioning, organizing, exporting, and optionally backing up weekly photo rolls.
By downloading, accessing, or using maku, you agree to these Terms. If you do not agree, do not use the app.
Nothing in these Terms limits any mandatory rights you may have under consumer protection laws.
Store terms
Section titled “Store terms”maku is distributed through the Apple App Store and Google Play. Your use of maku is also subject to the terms of the store from which you downloaded it, including Apple’s App Store terms and Licensed Application End User License Agreement on iOS, and Google Play’s terms on Android.
Apple and Google handle store purchases, subscriptions, refunds, and related account management according to their own terms.
Using maku
Section titled “Using maku”ptgms gives you a limited, personal, non-transferable license to use maku on devices you own or control, as allowed by the applicable store’s rules and these Terms.
You may not:
- copy, modify, redistribute, sell, or sublicense maku except where allowed by law;
- reverse engineer maku except where allowed by law;
- use maku to violate someone else’s rights, privacy, intellectual property, or legal protections;
- interfere with maku’s operation, subscription checks, cloud backup behavior, or third-party services;
- use maku for unlawful or harmful purposes.
maku does not require a maku account and ptgms generally does not know who individual users are.
Your photos and content
Section titled “Your photos and content”You keep ownership of photos, captions, albums, roll names, exports, and other content you create or store with maku.
maku may process your content only as needed to provide app features, such as saving photos locally, applying filters, organizing rolls and albums, searching captions and place names, exporting items you choose to export, and backing up your library to iCloud or Google Drive if you enable cloud backup.
You are responsible for the photos and content you create, save, export, or share, including making sure you have any rights or permissions needed.
maku does not claim ownership of your photos or captions.
Location tagging
Section titled “Location tagging”If you enable location tagging and grant location permission, maku may save location information with photos you take.
Location tagging can be turned off in maku settings or through your device settings. Turning it off affects future photos.
maku does not currently include a separate feature for removing a saved location tag from a photo without deleting the photo.
Cloud backup
Section titled “Cloud backup”Cloud backup is a maku+ feature.
If enabled, maku uploads photo files and library metadata so your library can be restored after reinstalling the app or moving to a new device:
- iOS: to the app’s private CloudKit database in your iCloud account
- Android: to your Google Drive account
Cloud backup depends on Apple or Google services, your platform account, device settings, network connection, available cloud storage, and platform backup behavior. maku tries to back up, restore, and delete backup records as designed, but cannot guarantee that every operation will complete immediately or without error.
Turning cloud backup off in maku asks for confirmation and then attempts to delete maku’s cloud backup records. Photos stored locally on your device are not deleted by that setting.
maku is a creative photo app, not guaranteed archival storage. Keep separate backups of anything especially important.
Subscriptions and purchases
Section titled “Subscriptions and purchases”maku may offer paid features through maku+.
Purchases and subscriptions are processed by Apple or Google and managed with RevenueCat.
Prices, billing periods, trial terms, renewal behavior, cancellation rules, and refund eligibility are shown during purchase and are governed by the applicable store and applicable law.
Subscriptions renew automatically unless canceled through Apple or Google before the renewal date according to the store’s rules. Deleting maku does not cancel a subscription.
Paid features may include custom filters, cloud backup, additional app icons, and other features shown in the app. Features may change over time, but ptgms aims to handle paid features fairly and consistently with store rules and applicable law.
Third-party services
Section titled “Third-party services”maku uses or may open third-party services, including Apple iOS services, Google Android services, device Photos apps, maps apps, iCloud/CloudKit, Google Drive, App Store or Google Play billing, RevenueCat, Sentry, and destinations you choose in the system share sheet.
Those services are governed by their own terms and privacy policies. ptgms is not responsible for third-party services, outages, content, or data handling outside maku’s control.
Privacy
Section titled “Privacy”Please read maku’s Privacy Policy to understand how the app handles information.
maku does not require a maku account and ptgms does not try to identify individual users. Most data stays on your device unless you enable cloud backup, make a purchase, send diagnostics, export content, or share content yourself.
App changes
Section titled “App changes”ptgms may update maku to add, change, or remove features, fix issues, improve reliability, or meet technical, legal, security, or store requirements.
Some features may require a supported iOS or Android version, cloud service availability, an active maku+ subscription, network access, or platform service availability.
Changes to these Terms
Section titled “Changes to these Terms”ptgms may update these Terms from time to time. The updated version will be posted with a new “Last updated” date.
Continued use of maku after updated Terms become effective means you accept the updated Terms. If you do not agree to updated Terms, stop using maku.
Disclaimers
Section titled “Disclaimers”maku is provided “as is” and “as available.”
maku is a creative photo app. It is not intended for emergency use, legal recordkeeping, professional archival storage, compliance archiving, or any use where loss of photos or metadata could cause serious harm.
To the fullest extent permitted by law, ptgms disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, and error-free performance.
Nothing in these Terms limits any rights that cannot legally be limited under applicable consumer protection laws.
Limitation of liability
Section titled “Limitation of liability”To the fullest extent permitted by law, ptgms will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost photos, lost data, lost profits, lost revenue, business interruption, or loss of goodwill arising from or related to maku or these Terms.
To the fullest extent permitted by law, ptgms’s total liability for any claim related to maku or these Terms will be limited to the amount you paid for maku or maku+ during the twelve months before the claim, or EUR 50, whichever is greater.
These limitations do not apply where liability cannot legally be limited or excluded, including where applicable for intentional misconduct, gross negligence, injury to life, body, or health, mandatory product liability, or mandatory consumer rights.
Governing law
Section titled “Governing law”These Terms are governed by the laws of Germany, unless mandatory consumer protection laws in your place of residence require otherwise.
