Terms of Use

These Terms of Use apply to your use of maku, an iOS app by ptgms for taking, captioning, organizing, exporting, and optionally backing up weekly photo rolls.

By downloading, accessing, or using maku, you agree to these Terms. If you do not agree, do not use the app.

Nothing in these Terms limits any mandatory rights you may have under consumer protection laws.

maku is distributed through the Apple App Store. Your use of maku is also subject to Apple’s App Store terms and the Apple Licensed Application End User License Agreement, unless a custom EULA applies.

Apple handles App Store purchases, subscriptions, refunds, and related account management according to Apple’s own terms.

ptgms gives you a limited, personal, non-transferable license to use maku on Apple devices you own or control, as allowed by Apple’s rules and these Terms.

You may not:

  • copy, modify, redistribute, sell, or sublicense maku except where allowed by law;
  • reverse engineer maku except where allowed by law;
  • use maku to violate someone else’s rights, privacy, intellectual property, or legal protections;
  • interfere with maku’s operation, subscription checks, iCloud backup behavior, or third-party services;
  • use maku for unlawful or harmful purposes.

maku does not require a maku account and ptgms generally does not know who individual users are.

You keep ownership of photos, captions, albums, roll names, exports, and other content you create or store with maku.

maku may process your content only as needed to provide app features, such as saving photos locally, applying filters, organizing rolls and albums, searching captions and place names, exporting items you choose to export, and backing up your library to your private iCloud database if you enable iCloud backup.

You are responsible for the photos and content you create, save, export, or share, including making sure you have any rights or permissions needed.

maku does not claim ownership of your photos or captions.

If you enable location tagging and grant iOS location permission, maku may save location information with photos you take.

Location tagging can be turned off in maku settings or through iOS Settings. Turning it off affects future photos.

maku does not currently include a separate feature for removing a saved location tag from a photo without deleting the photo.

iCloud backup is a maku+ feature.

If enabled, maku uploads photo files and library metadata to the app’s private CloudKit database in your iCloud account so your library can be restored after reinstalling the app or moving to a new device.

iCloud backup depends on Apple services, your Apple Account, device settings, network connection, iCloud storage, and CloudKit behavior. maku tries to back up, restore, and delete backup records as designed, but cannot guarantee that every operation will complete immediately or without error.

Turning iCloud backup off in maku asks for confirmation and then attempts to delete maku’s iCloud backup records. Photos stored locally on your device are not deleted by that setting.

maku is a creative photo app, not guaranteed archival storage. Keep separate backups of anything especially important.

maku may offer paid features through maku+.

Purchases and subscriptions are processed by Apple and managed with StoreKit and RevenueCat.

Prices, billing periods, trial terms, renewal behavior, cancellation rules, and refund eligibility are shown during purchase and are governed by Apple and applicable law.

Subscriptions renew automatically unless canceled through Apple before the renewal date according to Apple’s rules. Deleting maku does not cancel a subscription.

Paid features may include custom filters, iCloud backup, additional app icons, and other features shown in the app. Features may change over time, but ptgms aims to handle paid features fairly and consistently with Apple’s rules and applicable law.

maku uses or may open third-party services, including Apple iOS services, Apple Photos, Apple Maps, iCloud/CloudKit, StoreKit, RevenueCat, Sentry, and destinations you choose in the Apple share sheet.

Those services are governed by their own terms and privacy policies. ptgms is not responsible for third-party services, outages, content, or data handling outside maku’s control.

maku does not require a maku account and ptgms does not try to identify individual users. Most data stays on your device unless you enable iCloud backup, make a purchase, send diagnostics, export content, or share content yourself.

ptgms may update maku to add, change, or remove features, fix issues, improve reliability, or meet technical, legal, security, or App Store requirements.

Some features may require a supported iOS version, iCloud availability, an active maku+ subscription, network access, or Apple service availability.

ptgms may update these Terms from time to time. The updated version will be posted with a new “Last updated” date.

Continued use of maku after updated Terms become effective means you accept the updated Terms. If you do not agree to updated Terms, stop using maku.

maku is provided “as is” and “as available.”

maku is a creative photo app. It is not intended for emergency use, legal recordkeeping, professional archival storage, compliance archiving, or any use where loss of photos or metadata could cause serious harm.

To the fullest extent permitted by law, ptgms disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, and error-free performance.

Nothing in these Terms limits any rights that cannot legally be limited under applicable consumer protection laws.

To the fullest extent permitted by law, ptgms will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost photos, lost data, lost profits, lost revenue, business interruption, or loss of goodwill arising from or related to maku or these Terms.

To the fullest extent permitted by law, ptgms’s total liability for any claim related to maku or these Terms will be limited to the amount you paid for maku or maku+ during the twelve months before the claim, or EUR 50, whichever is greater.

These limitations do not apply where liability cannot legally be limited or excluded, including where applicable for intentional misconduct, gross negligence, injury to life, body, or health, mandatory product liability, or mandatory consumer rights.

These Terms are governed by the laws of Germany, unless mandatory consumer protection laws in your place of residence require otherwise.
